Franchisees And Dealers Nationwide
Serena I. Chiquoine
- Franchising 100%
As an attorney at Dady & Gardner, P.A. Serena concentrates her efforts on representing and advocating for franchisees, dealers and distributors facing all sorts of issues in their business relations with their franchisors, manufacturers and suppliers.
While settling cases early (and avoiding disputes in the first place) is Serena's preferred approach to the practice of law, she will not hesitate to initiate litigation if it becomes necessary.
Recently, Serena took on the franchisor of a men's hair salon system who had defrauded her client by misrepresenting critical information during the sales process, including making misrepresentations in the Franchise Disclosure Document. The dispute resulted in a three-day arbitration hearing in California. Serena ultimately secured dismissal of the franchisor's counterclaims, rescission of the franchise agreement and a seven-figure damages award for the franchisee, for which the franchisor's two control persons were also held individually liable. (Patterson v. Ultimate Franchises, Inc. et al., AAA Case No. 01-18-0000-3751 (Jan. 27, 2020) (Karp, Arb.))
Serena joined Dady & Gardner in 2016, having previously worked as a clerk and litigation associate at another law firm in the Twin Cities. Before deciding to focus on franchising, Serena successfully represented a number of clients in a wide range of legal matters, including complex family law issues, shareholder and partnership disputes, employment law and restrictive covenant defenses. This wealth of diverse experience helps Serena to be an excellent advocate for her clients - as franchisees, business owners, and individuals.
Serena graduated from the University of Minnesota Law School, magna cum laude, in 2014. While in law school, Serena received a number of scholarships and commendations, including making the Dean's List each semester and winning the University of Minnesota Book Award in Evidence for the Spring of 2013.
After earning her undergraduate degree, summa cum laude, in Sociology from the University of Minnesota, Serena spent three years recruiting and interviewing research participants at the Minnesota Center for Twin and Family Research (a.k.a. the "Minnesota Twin Study").
